DEA officially states delta-8- and delta-9-THCO as Schedule I controlled substances

A letter sent to attorney Rod Kight, in response to his subsequent letter and email to the chief of the drug and chemical evaluation section for the Drug Enforcement Administration (DEA), states that delta-8- and delta-9-THCO are considered to be Schedule I controlled substances.

Delta-8- and delta-9-THCO are not naturally occurring in the cannabis plant, only obtained synthetically, therefore do not fall under the definition of hemp. They have similar structures and pharmacological activities to tetrahydrocannabinols (THC), therefore are controlled in Schedule I.
