Growing, Selling Hemp Now Legal In Idaho

Governor Brad Little signed H.B. 126, the Hemp Research and Development Act, on April 16, 2021. The new law tasks the Idaho State Department of Agriculture (ISDA) with promulgating hemp rules and developing a state plan by Sept. 1, 2021.

ISDA is required to develop rules in time “to allow for the production, processing, transportation, and research of industrial hemp in Idaho under the state plan beginning with the spring 2022 growing season of industrial hemp.” Under the law, ISDA will conduct rulemaking in 2021. If USDA approves Idaho’s plan, hemp production would begin in 2022.
