Nevada Lawmakers Ban Employers From Denying Applicants Who Fail Marijuana Tests

Nevada has become the first state to ban employers from refusing to hire job applicants because they tested positive for marijuana in a drug screening.

A bill signed by Gov. Steve Sisolak prohibits, with some exceptions, employers from refusing to hire a prospective employee because the job seeker failed a pre-employment test for marijuana. The measure goes into effect on Jan. 1.

The provision does not apply to applicants seeking employment as firefighters or emergency medical technicians, or for driving positions that require an employee to undergo state or federal drug screenings. It also does not apply to federally funded jobs, as marijuana remains illegal under federal law.
